IPONZ releases new trademark search tool – The IP Office of New Zealand (IPONZ) has released a new trademark search tool, called ‘Trademark Check’, to more effectively allow users to search for words and logos on the New Zealand register. According to the registry, the new tool “has been developed for members of the general public who have a limited awareness of intellectual property”. A key feature is the automatic searching of words “that look or sound the same” to other marks – an innovative feature rarely seen on IP office search tools.

最近新西兰知识产权局（IPONZ）发布了一款新型的商标检索工具，以供公众自行检索近似商标。该检索工具的一大特点为图形检索，可以通过上传图像的方式搜索近似的图形商标，若无可上传的商标图形，也可以通过对图形描述的方式进行检索，在各个知识产权局中，该功能十分少见。

Before applying, use Trade Mark Check to see if a trade mark like yours already exists on the NZ Register. You can search by word, logo or image.

在申请之前，可在新西兰商标系统检索是否存在与申请商标近似或相同的在先商标。可以按文字，或图像进行检索。

2. Consider an initial assessment

考虑初步评估商标可注册性

If you're still not sure if your trade mark is unique enough, or are otherwise unfamiliar with the trade mark registration process, there is an application for a search and preliminary advice report before making an application to register your trade mark. A search and preliminary advice report will provide you with an assessment of whether your trade mark is likely to comply with two important areas that are examined under the Trade Marks Act 2002.

如果申请人仍然不确定商标是否足够独特，或者不熟悉商标注册程序，则在申请注册商标之前，可申请商标检索和初步评估报告。检索和初步评估报告将为申请人评估商标的可注册性，确定申请商标是否符合2002年“商标法”审查的两个重点。

This service will be charged for either a search report or a preliminary advice report.After receiving the report you can decide whether you’d like to stop, change or proceed with your application.

The trademark office will examine your application and produce a report within 15 working days.

There is substantive examination in New Zealand. The most common objection is that the application needs better classification of its goods or services. We have the opportunity to respond to any of the issues raised within 12 months from the date of the application was filed.

新西兰有实质审查。最常见的驳回是商品或服务分类问题的驳回。自申请日起算的12个月内，申请人可答复此类审查意见。

The request for review will only be considered once an objection has been maintained twice on the same grounds.

For any objections raised against the trade mark, we can respond to the office explaining why we disagree.

Registration

After you receive your acceptance notice, your trade mark application is advertised. If there is no opposition to your trade mark within three months, then your application should be registered at a minimum of six months after the filing date.

申请人收到官方的接受通知后，商标进入公告阶段，公告时间3个月。如果在三个月内没有收到任何异议，那么该申请在申请日起算满至少六个月的时候，将予以注册。

Trademark Renewal

商标续展

A trade mark registration can be renewed every 10 years.

注册后的商标，每十年可续展一次。

If the mark is not renewed by the due date the trade mark will expire. A trade mark may be restored up to 1 year after the trade mark registration has

gone ‘expired but restorable’ using the same process as a trademark renewal. If the trade mark is not restored within this 1 year period the trade mark will permanently expire.

如果商标未在到期日前续展，则商标将到期。新西兰商标局允许商标恢复过期的商标，期限是到期后一年内。如果商标未在1年内恢复，则商标将永久失效。

You can divide a registration, or an expired but restorable mark, when you’re not sure if you want to renew all classes.

如果申请人不确定是否要续展商标中的所有类别，可以选择将注册或已过期但可恢复的商标进行分割。

If you don't wish to renew all the classes in the trade mark, use an alteration request to strike out any classes that you don't wish to remain in the trade mark.

如果申请人不想续展商标中的所有类别，可申请删除不希望保留的类别。
