最近有个卖家来找亚易协助，说是产品被投诉了，定晴一看，居然还是从去年一直火到今年的PopSockets手机支架！
（这种网红产品，敢碰的卖家们，你们都是大心脏）
来瞅一眼某独立站卖家收到的投诉律师函：

To whom it may concern,
I hereby state under penalty of perjury that I am authorized to act on behalf of PopSockets LLC (“PopSockets”). PopSockets is the exclusive owner of several Intellectual Property Rights (“IPRs”) in different countries. PopSockets holds various patents in connection with phone grips and phone stands. Additionally, PopSockets owns many different kinds of copyrights on the text, artwork, pictures and audiovisual works on its homepage www.PopSockets.com.
Any exploitation (including but not limited to the use) of PopSockets’ IPRs must be expressly authorized by my client.
On gearvita.com, you are selling and offering for sale a patented invention. These products were not manufactured and/or provided by or with permission of PopSockets. I have a good faith belief that such use has not been authorized by PopSockets, its agents or the law, and constitutes patent infringement.
The website gearvita.com also displays copyright protected works owned by PopSockets. I have a good faith belief that such use has not been authorized by PopSockets, its agents or the law, and constitutes copyright infringement.
Therefore, on behalf of PopSockets I demand that you cease and desist all infringements of PopSockets IPRs and permanently take down the infringing webpages within 2 days after receiving this letter.
In case you do not comply with these demands within the above deadline, PopSockets will take further legal action.
The information contained in this letter is accurate and shall not affect in any way, the rights, remedies and/or defenses my client has, had, or may have for acting in this matter.
邮件中对方给了权利人的产品主页， 说卖家平台网站的产品侵犯了对方的发明专利，同时也侵犯了对方相关版权等。
专利权人和投诉人是PopSockets LLC，是一家设计生产手机支架的公司，虽然是去年才开始大火，但是该公司在知识产权保护方面做得不错，目前亚易了解到，在一年内，该公司分别从版权、商标、发明专利、外观专利等多种维度进行了多种侵权投诉。
投诉的方式如此多样化，PopSockets LLC其实受益于其完善的知识产权保护体系，亚易调查发现，该公司目前拥有多个商标（文字商标、图形商标都有）。
可以看到
PopSockets的商标注册类别包含了鼠标垫，这也就不难理解为什么有卖鼠标垫的卖家也被PopSockets LLC投诉导致店铺被冻结。当然，除了完善的商标注册体系之外，PopSockets LLC公司还手握多种欧美外观和发明专利。
所以说，针对侵权这款网红手机支架的卖家而言，PopSockets LLC公司确实是拥有很多种途径来保护自身利益。据悉，该公司早已委托GBC进行全面维权，平台涉及亚马逊/WISH/速卖通/自建站等。
特别注意！
自建站卖家不要以为没有在平台售卖，对方就无计可施。（上面的律师函就是独立站卖家收到的！）根据亚易掌握的卖家信息来看，现在不少自建站的侵权卖家都收到了律师信，要求侵权卖家收到邮件2天内停止一切侵权行为，删除相关侵权网站。要不，会收到法院的起诉文件。
当然，也有好消息
目前来看，PopSockets LLC这家公司自2017年开始通过GBC维权，2017年发起3起，2018年发起5起法院诉讼，频次还不算很高，其余的主要是通过平台来进行投诉要求卖家停止侵权行为，还没有大规模地发起法院诉讼对卖家进行进一步惩罚。
在收律师函 阶段，可以自己回复邮件说愿意删除，马上停止侵权行为并删除侵权产品，一般对方不会再提出下一步的诉讼。
如果收到的是法院传票就是已被对方发起诉讼，这种需要积极找律师去和解或应诉。
