Trade Mark Opposition

In Singapore, it is possible to stop the registration of a trade mark. This is known as trade mark opposition. Some grounds of opposition could be that the trade mark sought to be registered is descriptive of the goods or services for which registration is sought, or that it is confusingly similar to an earlier trade mark.

在新加坡，可以通过异议阻止某个商标的注册。异议理由可包括：商标对指定商品/服务具有描述性（即缺乏显著性），或者与在先商标构成近似混淆等。

The grounds for opposition, procedure and timelines are prescribed by law under the Trade Marks Act and Rules. The flowchart below outlines the procedures and timelines for opposing a trade mark application.

1. Opposing a Trade Mark Application Filed in Singapore

对新加坡单一商标注册提出异议申请

A trade mark application which has been accepted for registration is published in the Trade Marks Journal. Within 2 months after the date of publication, a person may oppose the registration of the trade mark by filing a notice of opposition in Form TM11. The procedure is as follows:

新加坡商标通过实质审查后，会在《商标杂志》上予以公布。自公告之日起两个月内，任何人可以通过提交TM11表格对已公告商标提出异议申请。具体流程如下：

An international trade mark registration which has been accepted for protection in Singapore shall be published in the Trade Marks Journal. Within 2 months after the date of publication, a person may oppose the protection of the trade mark by filing a notice of opposition in Form TM11. The procedure is as follows:

Trade Mark Invalidation or Revication

In Singapore, it is possible to invalidate or revoke a registered trade mark.

在新加坡，可以对已注册商标提出无效或撤销申请。

Invalidation and revocation are two very different processes.

无效和撤销是两个截然不同的程序。

Invalidation is intended to remove from the register marks which should never have been registered in the first place, because such marks fail to satisfy the registration criteria. For example, the registered trade mark is descriptive of the goods or services for which registration is sought, or is confusingly similar to an earlier trade mark.

无效程序的目的旨在将已注册商标从官方注册簿中删除，如同该商标从未注册过一般。原因是该商标不符合注册标准。例如，注册商标对指定商品/服务具有描述性（即缺乏显著性），或者与在先商标构成近似混淆。

Revocation, on the other hand, is intended to remove marks whose initial registration was valid, but which should not be allowed to remain on the register. The reason could be because of the proprietor’s failure to use the registered trade mark or because it has become the common name in the trade for the product or service for which it is registered, or because it has become misleading. Revocation allows such marks to be released to the public for use.

撤销旨在删除那些初始注册有效但不应继续保留在注册簿上的商标。原因可能是因为商标所有人未对该注册商标投入使用，或者因为商标已成为所在商品/服务行业的通用名称，又或者因为商标具有误导性。撤销意味着此类商标资源将会被公开并为公众所用。
